Artiste Terms and Conditions
1. Who we are and the nature of this agreement
1.1 Lost in Casting is a trading name of Lost in TV Limited, company number 04801855, registered office 82A James Carter Road, Mildenhall, Suffolk IP28 7DE ("we", "us") – the company behind Lost in TV, ticketing television audiences since 2003.
1.2 We operate as an employment agency under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003, introducing supporting artistes to film, television and commercial productions.
1.3 These terms form a binding agreement between you and us from the point you submit your registration. We provide no work-finding services until you have agreed them.
2. Eligibility
2.1 You must be 18 or over. We do not represent under-18s and do not accept junior briefs.
2.2 You must have the right to work in the UK and provide documentary evidence before you can be confirmed on any booking. We verify documents and record expiry dates; if your document expires, bookings are paused until a current document is verified.
2.3 Registration is free. We never charge you a fee for finding you work. Our only charge is the commission at clause 8.
3. Your profile
3.1 You are responsible for the accuracy of your profile – measurements, photos, skills, availability and contact details – and for keeping it current. Productions book from this information; inaccuracy can cost you and us bookings.
3.2 Photographs you upload must be of you and owned by you. You grant us a licence to show your profile to productions for casting purposes.
3.3 New profiles are reviewed by our team before going live. We may decline or remove a profile at our discretion.
3.4 Your registration runs for 12 months from approval and renews for further 12-month periods when you confirm your details are current – we will remind you before expiry. If you do not renew, your profile is hidden from productions and then deleted in line with our Privacy Policy.
4. Casting calls, applications and offers
4.1 Work may come to you by either route: we advertise casting briefs to our network and the Lost in TV audience for you to apply to, and productions (or we) may select you directly from your profile through our talent search. Applying to a casting call is not a booking; a booking exists only when you accept an offer and we confirm it.
4.2 Offers are made through your dashboard and by email. Offers not answered promptly may be withdrawn.
4.3 By accepting an offer you commit to the shoot date, location and call time shown, at the rate shown.
5. On set: conduct
5.1 Arrive by your call time, ready to work, with any wardrobe or preparation the booking requires.
5.2 Follow the reasonable instructions of the production team and assistant directors, and comply with all site health-and-safety rules.
5.3 Professional behaviour is expected throughout. Attending under the influence of alcohol or drugs, harassment, or repeated lateness are grounds for immediate removal from our books.
6. Cancellation
6.1 If you cancel a confirmed booking: contact us as early as possible so we can tell the production and, where there is time, replace you. (a) before 12:00 midday on the day before the shoot – no penalty; (b) repeated late cancellation or failure to attend ("no-show") may result in suspension or removal from our books.
6.2 If the production cancels your confirmed booking, you are owed a cancellation fee which we collect on your behalf: (a) cancelled before 12:00 midday the day before the shoot – no fee; (b) cancelled after midday the day before – 50% of your day rate; (c) cancelled after 15:00 the day before, or on the day – 100% of your day rate. Cancellation fees are paid through the normal payment process and are subject to commission.
7. Your hours and pay record (the digital chit)
7.1 On set you are signed in and out through our digital chit system. The chit records your hours, any overtime and night hours, and agreed extras (travel, meal, costume, fitting, continuity or other fees).
7.2 Rates follow the union agreement stated on the booking (FAA/PACT, Equity/PACT, BBC/Equity, ITV/Equity) or the commercial rate agreed. A standard day is 10 hours. For union engagements, overtime is paid at 1.5× the hourly rate for the first 2 hours and 2× thereafter; for commercials and other non-union engagements, overtime is paid at one fifth of the daily rate per hour, in line with industry practice. Hours between 20:00 and 06:00 attract a night premium of 1.33×.
7.3 After the assistant director signs the chit off, we send it to you for review. You have 48 hours to accept it or raise a query. If we hear nothing within 48 hours the chit is accepted automatically – this keeps everyone's pay moving. If you query, we investigate, adjust where justified, and tell you the outcome; the payment then proceeds on the resolved figures. Automatic acceptance never bars the correction of a genuine error – tell us and we will put right any demonstrated mistake.
8. Our commission
8.1 We deduct a commission of 20% plus VAT from the gross amounts we collect for you. VAT is charged on the commission only, never on your fees, and is itemised on every remittance.
8.2 Commission applies to all sums we collect for you in respect of an engagement, including allowances and supplements recorded on your chit (such as travel and meal allowances). This reflects standard industry practice.
9. Payment
9.1 Productions pay us; we then pay you the net amount by BACS transfer to the account in your profile. We aim to pay you within 10 working days of receiving cleared funds from the production. We keep you informed of payment status on your dashboard.
9.2 We are dependent on the production paying us; we pursue late payers actively (our production terms impose a late-payment surcharge) but cannot pay out what we have not received.
9.3 You are responsible for the accuracy of your bank details. We store them encrypted and use them solely to pay you.
9.4 You will receive a remittance for each payment showing gross, commission and net.
10. Self-employment and tax
10.1 You are a self-employed worker. Nothing in these terms creates employment between you and us or, save as a production may separately agree, between you and any production.
10.2 You are responsible for your own tax and National Insurance and for declaring your earnings to HMRC.
11. Confidentiality and social media
11.1 Everything you see and hear on a production is confidential: scripts, storylines, sets, cast and crew.
11.2 On set you must not make recordings or take photographs except where the production permits. You must not post about a production – including its name, location, cast or your role – on any social media or public forum until the production releases the information or gives permission.
11.3 Breach of this clause is grounds for immediate removal from our books and may expose you to claims from the production.
12. Image and likeness
12.1 Productions require consent to use your image. For each booking you will be asked to sign a release form electronically through the chit system; its terms are between you and the production. We store your signed release with the booking record.
13. Data protection
13.1 We process your personal data as described in our Privacy Policy, including physical characteristics, photographs, right-to-work documents, and – with your explicit consent – ethnicity, which productions use for casting searches. Bank details and National Insurance numbers are stored encrypted and never shared with productions.
14. Liability
14.1 On set, the production is responsible for your health and safety and holds the relevant insurances. We are not liable for injury or loss occurring on a production's premises except where caused by our own negligence.
14.2 Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
14.3 We do not guarantee you any volume of work, or any work at all.
15. Suspension, termination and removal
15.1 You may leave our books at any time by written notice.
15.2 We may suspend or remove your profile for breach of these terms (with immediate effect for serious breach), extended unavailability, or where our relationship with you has broken down.
15.3 On removal we retain what we must for legal and financial record-keeping (see Privacy Policy) and delete the rest.
16. General
16.1 We may update these terms; we will give you notice of material changes and your continued use of the service after the notice period constitutes acceptance. The version you accepted, and when, is recorded on your account.
16.2 These terms are the entire agreement between us concerning our work-finding services.
16.3 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
